Chapter 1 General Provisions
Article 1 In order to strengthen elevator safety management, prevent elevator safety accidents, and protect personal and property safety, in accordance with the "Special Equipment Safety Law of the People's Republic of China", the State Council's "Special Equipment Safety Supervision Regulations" and "Jiangsu Province Special Equipment Safety Regulations" and other laws , regulations, and in light of the actual situation of this city, formulate these regulations.
Article 2 These regulations shall apply to the selection, configuration, production (including design, manufacture, installation, transformation and repair), use, maintenance, inspection, testing, emergency response and supervision and management of elevators within the administrative area of this Municipality.
The elevators mentioned in these Regulations include passenger (cargo) elevators, escalators, moving walks, etc. The specific scope is determined in accordance with the catalogue of special equipment prescribed by the state.
Article 3 Municipal, county-level city and district people's governments shall strengthen the leadership of elevator safety supervision and management, incorporate elevator safety supervision and management into the content of government safety responsibility assessment, urge relevant departments to perform elevator safety supervision and management duties in accordance with the law, and establish elevator safety supervision and management functions. Management coordination mechanism, timely coordinate and solve major problems in elevator safety supervision and management, and incorporate elevator safety supervision and management funds into the financial budget.
The town people's government, sub-district offices, and development zone (park) management agencies shall cooperate and assist in the work related to elevator safety supervision and management.
Article 4 The market supervision and management department is responsible for the supervision and management of elevator safety within its own administrative area.
The departments of development and reform, education, industry and informatization, public security, housing and urban-rural construction, transportation, commerce, cultural and tourism, health, emergency management and other departments shall, in accordance with their respective responsibilities, do a good job in the supervision and management of elevator safety.
Article 5 Elevator production, use, and maintenance units and inspection and testing agencies engaging in corresponding activities shall comply with the requirements of laws, regulations, safety technical norms and standards, and be responsible for the safety of elevators produced, used, maintained, inspected, and tested.
Article 6 The market supervision and administration department shall strengthen the publicity and education of elevator safety laws and regulations, popularize elevator safety knowledge, and enhance the public's elevator safety awareness and self-protection ability.
Organs, groups, enterprises and institutions, village (resident) committees, etc. shall carry out publicity and popularization of elevator safety knowledge, and advocate civilized use of elevators.
Kindergartens and schools should take elevator safety knowledge as an important part of safety education, and cultivate children and students the habit of using elevators in a safe and civilized manner.
News media should carry out public welfare publicity about elevator safety and guide the public to use elevators correctly.
Article 7 Encourage the adoption of new technologies and methods such as big data and the Internet of Things to promote the intelligent and information-based development of elevator production, use, maintenance, inspection, testing, emergency response, and supervision and management, and to improve the level of elevator safety management.
Article 8 Elevator manufacturing units, user units and maintenance units are encouraged to purchase elevator safety liability insurance individually or jointly.
Promote elevator safety liability insurance for elevators in schools, medical institutions, stations, shopping malls and other public gathering places.
Article 9 Elevator industry associations shall strengthen industry self-discipline management, formulate industry service standards, participate in the formulation of relevant standards, promote the construction of industry integrity systems, and promote industry orderly competition and standardized operation.
Chapter 2 Selection, Configuration and Production
Article 10 The selection and configuration of elevators shall be adapted to the building structure and use requirements, comply with relevant national and provincial regulations and standards, and ensure rescue and barrier-free passage.
The escalators and moving walks newly installed in stations, airports, passenger terminals, rail transit stations, pedestrian crossing facilities and other places shall use public transport elevators that meet the standards in accordance with relevant state regulations.
Where an elevator is installed in a construction project using fiscal funds, the elevator safety performance, failure rate, and after-sales service and credit status of the elevator manufacturing unit and sales unit shall be included in the evaluation content of procurement or bidding.
Article 11 For new construction, reconstruction and expansion projects, the construction unit shall entrust a unit with corresponding qualifications to carry out the design and construction of elevator civil works such as elevator shafts, pits, machine rooms and landings in accordance with the requirements of laws, regulations and safety technical specifications , Supervision. The anti-leakage warranty period for elevator civil works shall not be less than five years, which shall be calculated from the date of acceptance of the completion of the project.
If an elevator is added to an existing residence, the civil construction shall comply with the project quality requirements, and the anti-leakage warranty period shall comply with the provisions of the preceding paragraph.
Article 12 The elevator manufacturer is the main body responsible for product quality, and shall be responsible for the safety performance of the elevator and perform the following obligations:
(1) Provide technical guidance and services necessary for the safe operation of elevators, and assist in troubleshooting elevator failures;
(2) Follow up and investigate and understand the safe operation and maintenance of elevators, and put forward suggestions for improvement on existing problems;
(3) If the elevator has an identity defect that endangers safety due to design, manufacturing and other reasons, it shall immediately stop manufacturing, take the initiative to recall it, notify the user in a timely manner, and report to the market supervision and management department;
(4) Other obligations stipulated by laws, regulations and safety technical specifications.
Elevator manufacturing units shall not adopt any technical means to limit the normal maintenance of elevators and affect the safe operation of elevators.
Article 13 If an elevator manufactured overseas is sold in this city, and the manufacturing unit has not established a direct sales organization in China, it shall be clear that the agent registered in the territory shall first assume the safety responsibility of the elevator manufacturing unit stipulated by laws and regulations.
Article 14 Before the newly installed passenger elevator is delivered for use, the construction unit shall complete the mobile communication signal coverage of the elevator car and the hoistway.
Encourage existing manned elevator cars and shafts to achieve mobile communication signal coverage.
Article 15 After the newly installed passenger elevator is delivered for use, the elevator manufacturing unit and maintenance unit shall transmit the elevator safety operation data in real time to the Internet of Things smart supervision platform uniformly established by the Municipal People's Government.
When the existing manned elevators are renovated, the functions of data collection and transmission of elevator safe operation should be realized.
Article 16 An elevator manufacturer or sales unit shall bear the responsibility for quality warranty of the elevators it manufactures and sells. The minimum warranty period shall not be less than five years from the date of passing the elevator installation supervision and inspection.
Repair services involving elevator quality problems are provided within the warranty period, and no fee shall be charged.
Article 17 The installation, modification and repair of elevators shall be carried out by the elevator manufacturing unit or by a unit with corresponding qualifications entrusted by it. The entrusted unit shall not sub-entrust or in a disguised form to entrust the elevator installation, transformation and repair business.
If the original elevator manufacturing unit has been cancelled or no longer has the corresponding qualifications, and the elevator needs to be renovated or repaired, the elevator user unit may entrust other units with corresponding qualifications to implement it with the consent of the owner. The construction unit shall be responsible for the safety performance of the elevator after renovation or repair.
If the elevator is to be renovated, the construction unit shall replace the elevator product sign, indicating the name of the renovation unit, the date of renovation, and the number of the renovation qualification certificate and other relevant information.
Article 18 Before elevator installation, renovation and repair, the construction unit shall formulate a safety construction plan, implement safety protection measures, and inspect the elevator shaft, pit, machine room and landing and other civil works in accordance with the requirements of elevator design documents and standards. Confirm the elevator condition and meet the requirements before construction.
Article 19 After the installation, transformation and repair of the elevator are completed and passed the supervision and inspection, the elevator construction unit shall hand over the key and relevant materials to the elevator user, which is the delivery for use. The elevator construction unit shall take measures to ensure the safety of the elevator before delivery.
Article 20 It is supported to add elevators to existing residences where conditions permit, and the added elevators shall meet the requirements of elevator safety management.
Chapter 3 Use Management
Article 21 The elevator user shall be determined in accordance with the following provisions:
(1) If the newly installed elevator has not been handed over to the owner, the construction unit shall be the user;
(2) If the elevator belongs to one owner, the owner is the user;
(3) If the elevator is jointly owned by multiple owners, and the owners manage it by themselves, the owner shall determine the user through a written agreement;
(4) Where the right to use a place containing an elevator is leased, lent or otherwise transferred, it may be agreed that the user shall be the user; if there is no agreement, the owner of the elevator shall be the user;
(5) If the management is entrusted to a property service provider, the trustee shall be the user unit.
If an elevator is added to an existing residence, the owner shall determine the unit of use before the elevator is put into use.
If the elevator user cannot be determined, the local town people's government, sub-district office, and development zone (park) management agency shall urge the owner to determine the user, or designate the user.
Article 22 The elevator user shall go through the registration of elevator use according to law; if the elevator user changes, it shall go through the change registration with the market supervision and administration department within 30 days from the date of change.
When the elevator user changes, the complete elevator safety technical file and other relevant materials should be handed over.
Article 23 The elevator user is the main body responsible for the safety of elevator use, should be responsible for the safety of elevator use, and perform the following obligations:
(1) Establish elevator safety management system and elevator safety technical files.
(2) Elevator safety management institutions shall be set up or equipped with elevator safety management personnel in accordance with regulations, and publicity shall be made in the management area.
(3) Post effective signs for the use of special equipment, instructions for safe use, the contact person and contact information of the elevator user, and emergency rescue telephone numbers in prominent positions in the elevator car.
(4) Keep the elevator shaft, pit, machine room, etc. dry and free of water leakage, and meet the environmental requirements such as temperature, humidity, and illumination for the safe operation of the elevator.
(5) Conduct on-site supervision and signature confirmation of maintenance operations, cooperate with on-site safety work, and incorporate the confirmation data into the elevator safety technical file.
(6) If the elevator is found to be faulty or abnormal, or receives a report of the hidden danger of the accident from the elevator maintenance unit and inspection and testing agency, it shall organize a comprehensive inspection in time to eliminate the hidden danger of the accident; before the hidden danger of the accident is eliminated, the elevator shall be stopped.
(7) Carry out daily inspections on the use of elevators, keep the elevator hall, elevator doors and the inside of the car clean and tidy, guide and supervise the correct use of elevators by passengers, and promptly discourage abnormal use of elevators.
(8) Other obligations stipulated by laws, regulations and safety technical specifications.
Article 24 Elevator users in public gathering places and residential quarters shall equip elevators with video surveillance facilities that comply with public safety video management regulations, and ensure the normal operation of public safety video surveillance facilities.
The collection, use and management of video image information shall be carried out in accordance with the law and shall not infringe upon the legitimate rights and interests of others.
Article 25 The decoration of the elevator car can only be put into use after the decoration is completed and confirmed by the elevator manufacturer or if it conforms to the relevant safety technical specifications after inspection and testing.
Installation of electronic display screens and other facilities in the elevator car shall not affect the safety performance of the elevator.
Article 26 If one of the following circumstances may affect the safety of elevator use, the elevator user may entrust an institution with inspection and testing qualifications to conduct elevator safety assessment:
(1) The elevator has been used for more than 15 years;
(2) Casualties caused by elevator failure;
(3) Disabled due to the impact of floods, fires, earthquakes and other disasters;
(4) Other circumstances that affect the safe use of elevators.
The conclusion of the elevator safety assessment should be used as a reference for whether to continue to use the elevator or to renovate, repair or update the elevator.
Article 27 If the elevator user deactivates the elevator, it shall take necessary safety protection measures.
If the elevator is to be out of use for more than one year, the elevator user shall notify the market supervision and administration department in writing within 30 days from the date of deactivation. If the elevator is reactivated, the elevator user shall conduct inspection in accordance with relevant national and provincial regulations, and can only be activated after passing the inspection, and notify the market supervision and management department in writing.
Article 28 If the elevator has serious hidden dangers of accidents, has no value for transformation or repair, or meets other scrapping conditions stipulated in the safety technical regulations, the elevator user shall perform the scrapping obligation according to law, take necessary measures to eliminate the function of the elevator, and report to the original registered person. The market supervision and administration department shall go through the cancellation procedures of the use registration certificate.
Article 29 If the elevators in residential areas need to be renovated, repaired or updated, they may apply for the use of special residential maintenance funds in accordance with regulations. If there is no special residential maintenance fund or the special residential maintenance fund is insufficient, the elevator owner shall bear the relevant expenses.
Municipal, county-level city and district people's governments may, according to the needs of the safety management of old elevators in their respective administrative regions, establish a financing mechanism for elevator renovation, repair, and renewal.
Article 30 Elevator passengers shall abide by the requirements of elevator safety precautions and warning signs, and shall not have the following behaviors that affect the safe operation of elevators:
(1) Take an elevator that is expressly inactive;
(2) Use the elevator beyond the rated load;
(3) Carrying flammable, explosive and other dangerous substances or other substances that may affect the safety of elevators;
(4) Playing, playing, jumping, smoking in the elevator, or climbing, retrograde, or staying at the entrance or exit of the running escalator or moving sidewalk;
(5) Using abnormal means to open elevator landing doors and car doors;
(6) Destroying elevator safety signs, rescue signs, spare parts and other ancillary facilities;
(7) Leaving construction (decoration) garbage, domestic garbage, and defecation in the elevator car;
(8) Use emergency stop devices in non-emergency situations;
(9) Other behaviors that affect the safe operation of elevators.
It is forbidden to use a passenger elevator to carry electric bicycles or their batteries. Any unit or individual has the right to dissuade; those who do not obey the dissuasion shall report to the fire rescue agency in a timely manner.
Chapter IV Maintenance, Inspection and Testing
Article 31 Units that carry out elevator maintenance business shall meet the corresponding qualification requirements, set up fixed office spaces, and be equipped with corresponding qualified operators, and notify the market supervision and administration department in writing before carrying out elevator maintenance work for the first time. If the information changes, it shall notify the market supervision and administration department within 15 days from the date of the change.
Article 32 The elevator maintenance unit shall be responsible for the safety performance of its maintenance elevator, and abide by the following provisions:
(1) According to the elevator safety technical specifications, relevant standards and the actual situation of elevator use, formulate a maintenance plan;
(2) Establish elevator maintenance files, record the maintenance situation truthfully, and keep the files for a period of not less than four years;
(3) Use the unit's operators to carry out maintenance;
(4) At least once a year, organize safety education and skills training for the operators of the unit, and keep the records of safety education and skills training for not less than two years;
(5) Conduct irregular inspections on the maintenance quality of elevators, supervise and record the performance of duties by operators;
(6) Necessary safety protection measures shall be taken at the maintenance site. If the protection measures are not sufficient to ensure safety, the Special personnel should be dispatched to protect the site and ensure construction safety;
(7) The replaced elevator parts shall have the product quality certificate, and the safety protection device shall have the type test certificate;
(8) After discovering the fault or receiving the fault notification, the fault shall be eliminated in time; if the fault is temporarily difficult to be eliminated, the elevator user shall be informed of the solution in writing, and the elevator user shall be informed to stop the elevator before the fault is eliminated.
For elevators used in high-intensity public gathering places, the maintenance frequency and maintenance items should be increased.
Article 33 The elevator maintenance unit shall not subcontract or subcontract the maintenance business without the consent of the elevator user.
Article 34 If an elevator maintenance unit finds any of the following circumstances, it shall submit a written opinion to the elevator user to stop the elevator, cooperate with the elevator user to take effective safety measures, and report to the market supervision and management department:
(1) using elevators that have not been inspected or failed to pass inspection;
(2) using elevators that have been deactivated or scrapped;
(3) Renovating, repairing or updating elevators in violation of regulations;
(4) Other situations that seriously endanger the safety of elevator use.
Article 35 Promote the large-scale and professional development of elevator maintenance units, and use advanced technologies such as digitalization and advanced management methods to carry out elevator maintenance.
Encourage elevator maintenance units to carry out self-declaration of service standards and public commitment to service quality, publicize maintenance plans, maintenance implementation and other information, and provide services that are better than national standards.
Elevator maintenance units can take targeted offline on-site maintenance based on real-time online inspection and monitoring of maintenance conditions.
Article 36 Institutions engaged in elevator inspection and testing shall obtain corresponding qualifications in accordance with the law, abide by the relevant regulations on elevator inspection and testing, and before the first elevator inspection and testing in this city, the organization's qualifications, office space, employees , Quality assurance system and relevant information on inspection and testing work shall be notified in writing to the municipal market supervision and management department.
Article 37 Elevator inspection and testing agencies shall carry out inspection, testing and safety assessment work in accordance with the requirements of laws, regulations and safety technical specifications, issue reports objectively and in a timely manner, be responsible for inspection, testing results and evaluation conclusions, and pass data as required The information exchange system submits the report to the market supervision and management department.
Article 38 If the elevator inspection and testing agency finds that the elevator has hidden dangers in the inspection and testing, it shall notify the elevator user in writing; if it is a serious hidden danger, it shall report to the market supervision and management department at the same time.
Chapter V Emergency Response
Article 39 The municipal, county-level city and district people's governments shall establish an elevator emergency rescue system to coordinate and ensure the safety and emergency rescue of elevators in a unified manner.
Article 40 The market supervision and management department shall formulate elevator emergency plans, use the city's unified elevator safety emergency response platform to organize, direct and coordinate the city's elevator emergency rescue work, and connect with the Internet of Things smart supervision platform to achieve information sharing.
The public security organs and fire rescue agencies shall cooperate in the elevator safety emergency rescue and disposal work according to their duties, and support the operation of the elevator safety emergency disposal platform.
The elevator maintenance unit shall execute the dispatch instructions of the elevator safety emergency response platform; if the elevator safety emergency response platform fails to respond to the dispatch command in time, the elevator safety emergency response platform can dispatch other elevator maintenance units nearby for rescue.
Article 41 The elevator users and maintenance units shall formulate special emergency plans for elevator accidents, and conduct emergency drills in accordance with the requirements of safety technical regulations.
Article 42 An elevator user shall establish a 24-hour duty system, set up a duty telephone and keep it unblocked.
After discovering the elevator trapped person failure or receiving the elevator trapped person failure report, the elevator user shall organize rescue immediately, notify and assist the maintenance unit to carry out the rescue, and take measures to appease the trapped person and rescue the injured person.
In the event of an elevator accident, the elevator user shall immediately notify the maintenance unit to organize emergency rescue, protect the accident site, prevent the accident from expanding, and promptly report to the market supervision and management department where the accident is located.
Article 43 Except for force majeure, the elevator maintenance unit shall rush to the scene within 30 minutes to carry out rescue after receiving the report of the elevator trapped person failure. Fault.
Article 44 After receiving an elevator accident report, the market supervision and management department shall immediately rush to the scene to investigate and understand the situation, instruct elevator users and maintenance units to carry out on-site rescue, and conduct investigation and handling in accordance with relevant state regulations.
Article 45 If personal injury is caused by an elevator accident, the elevator user shall do a good job in the rescue of the injured person. If the elevator safety liability insurance has been insured, the elevator user shall notify the elevator insurer to activate the emergency advance payment and payment mechanism for elevator accidents in a timely manner.
Chapter VI Supervision and Management
Article 46 The market supervision and management department shall formulate a safety supervision and inspection plan every year, and conduct supervision and inspection of elevator production, use, and maintenance units and inspection and testing institutions in accordance with relevant regulations.
Supervision and inspection may entrust professional institutions to provide technical services, and the results of supervision and inspection shall be announced to the public in a timely manner.
Article 47 The market supervision and management department shall implement key safety supervision and inspection on the following elevators:
(1) Elevators used in public gathering places;
(2) Elevators that have had accidents in the past two years;
(3) Elevators with more than two trapped failures within 30 days;
(4) Other elevators that need to implement key supervision and inspection.
Article 48 The market supervision and management department shall conduct an annual assessment of elevator maintenance units, and disclose the assessment results to the public.
Article 49 The housing and urban-rural development department shall do a good job in the selection and configuration of elevators, the design review of civil works, waterproofing, power supply and distribution and other supporting facilities, and the supervision of the construction quality of elevator civil works such as elevator shafts, pits, and machine rooms.
The public security organ shall investigate and deal with illegal acts that damage elevator facilities, disturb the order of passengers, and impede the safety of operation in accordance with the law.
Departments of education, transportation, commerce, culture, broadcasting, tourism, health and other departments shall urge elevator users in the industry to fulfill their elevator use safety obligations.
Article 50 The town people's government, the sub-district office, and the management agency of the development zone (park) shall assist the relevant departments to conduct daily inspections of elevator safety, urge the implementation of elevator safety responsibilities, and coordinate and handle conflicts and disputes in the use of elevators.
Article 51 The market supervision and management department shall establish an elevator safety complaint and report system, and announce the channels for complaints and reports.
Any unit or individual who discovers behaviors that endanger elevator safety may file a complaint or report to the market supervision and management department. The market supervision and management department shall investigate and handle in a timely manner, and inform the complainant or whistleblower of the handling result.
Article 52 In the event of an elevator accident, the hidden danger of the accident has not been eliminated in a timely manner, or there are other safety management problems, the market supervision and management department may interview the main person in charge of the relevant unit and require them to implement elevator safety responsibilities.
Article 53 The municipal market supervision and management department shall issue a report on the safety status of elevators in this city every year, reflecting the status of elevator quality and maintenance quality.
Chapter VII Legal Liability
Article 54 For those who violate the provisions of these Regulations and the laws and regulations have provisions on punishment, the provisions shall prevail.
Article 55 Violating the provisions of the first paragraph of Article 15 of these regulations, the elevator manufacturing unit and maintenance unit fail to transmit the elevator safety operation data in real time to the Internet of Things smart supervision platform uniformly established by the Municipal People's Government, and shall be subject to market supervision and management The department shall order it to make corrections within a time limit; if it fails to make corrections within the time limit, it shall impose a fine of not less than 10,000 yuan but not more than 30,000 yuan.
Article 56 If the elevator user violates the provisions of Article 23, item 5 of these regulations, and the elevator user fails to conduct on-site supervision and signature confirmation of the maintenance operation, the market supervision and management department shall order it to make corrections within a time limit; A fine of not less than 1,000 yuan but not more than 20,000 yuan.
Article 57 In violation of the provisions of Article 28 of these Regulations, the elevator has serious hidden dangers of accidents, has no value for renovation or repair, or meets other scrapping conditions stipulated in the safety technical regulations, and the elevator user fails to perform the scrapping obligation and handle the use registration according to law. If the certificate is cancelled, the market supervision and administration department shall order to stop using the elevator and impose a fine of not less than 30,000 yuan but not more than 300,000 yuan.
Article 58 If an elevator passenger violates the provisions of Article 30, Paragraph 1, Item 1 to Item 8 of these regulations, and the elevator passengers have behaviors that affect the safe operation of the elevator, the relevant departments shall order corrections and impose penalties according to law; it constitutes a violation of public security management. If a crime is constituted, criminal responsibility shall be investigated according to law; if personal or property damage is caused to others, it shall be liable for compensation according to law.
Violating the provisions of paragraph 2 of Article 30 of these Regulations, if an elevator passenger uses a passenger elevator to carry an electric bicycle or its battery, and refuses to obey the dissuasion, the fire rescue agency shall impose a fine of not less than 200 yuan but not more than 1,000 yuan; Those who conduct public security administration shall be punished according to law; those who constitute a crime shall be investigated for criminal responsibility according to law; those who cause personal or property damage to others shall be liable for compensation according to law.
Article 59 If the elevator maintenance unit violates the provisions of Article 32, paragraph 1, item 3 of these regulations, the elevator maintenance unit does not use its operators to carry out maintenance, the market supervision and management department shall order it to make corrections, and impose a fine of more than 10,000 yuan and three A fine of less than 10,000 yuan.
Article 60 If the elevator maintenance unit violates the provisions of Article 33 of these regulations, the elevator maintenance unit subcontracts or subcontracts the maintenance business without the consent of the elevator user unit, the market supervision and management department shall order it to make corrections, and impose a fine of more than 10,000 yuan and 100,000 yuan. The following fines.
Article 61 In violation of the provisions of Article 37 of these Regulations, elevator inspection and testing institutions fail to submit reports to the market supervision and management department through the data information exchange system as required, the market supervision and management department shall order them to make corrections within a time limit; , and impose a fine of not less than 10,000 yuan but not more than 30,000 yuan.
Article 62 If an elevator user violates the provisions of the first paragraph of Article 42 of these Regulations and fails to establish a 24-hour duty system or fails to set up a duty telephone and keep it unblocked, the market supervision and management department shall order it to make corrections within a time limit and impose a penalty of one penalty on it. A fine of not less than 10,000 yuan but not more than 100,000 yuan.

Chapter 1 General Provisions
Article 1 In order to strengthen elevator safety management, prevent elevator safety accidents, and protect personal and property safety, in accordance with the "Special Equipment Safety Law of the People's Republic of China", the State Council's "Special Equipment Safety Supervision Regulations" and "Jiangsu Province Special Equipment Safety Regulations" and other laws , regulations, and in light of the actual situation of this city, formulate these regulations.
Article 2 These regulations shall apply to the selection, configuration, production (including design, manufacture, installation, transformation and repair), use, maintenance, inspection, testing, emergency response and supervision and management of elevators within the administrative area of this Municipality.
The elevators mentioned in these Regulations include passenger (cargo) elevators, escalators, moving walks, etc. The specific scope is determined in accordance with the catalogue of special equipment prescribed by the state.
Article 3 Municipal, county-level city and district people's governments shall strengthen the leadership of elevator safety supervision and management, incorporate elevator safety supervision and management into the content of government safety responsibility assessment, urge relevant departments to perform elevator safety supervision and management duties in accordance with the law, and establish elevator safety supervision and management functions. Management coordination mechanism, timely coordinate and solve major problems in elevator safety supervision and management, and incorporate elevator safety supervision and management funds into the financial budget.
The town people's government, sub-district offices, and development zone (park) management agencies shall cooperate and assist in the work related to elevator safety supervision and management.
Article 4 The market supervision and management department shall be responsible for the supervision and management of elevator safety within its own administrative area.
The departments of development and reform, education, industry and informatization, public security, housing and urban-rural construction, transportation, commerce, cultural and tourism, health, emergency management and other departments shall, in accordance with their respective responsibilities, do a good job in the supervision and management of elevator safety.
Article 5 Elevator production, use, and maintenance units and inspection and testing agencies engaging in corresponding activities shall comply with the requirements of laws, regulations, and safety technical specifications and standards, and be responsible for the safety of elevators produced, used, maintained, inspected, and tested.
Article 6 The market supervision and management department shall strengthen the publicity and education of elevator safety laws and regulations, popularize elevator safety knowledge, and enhance the public's elevator safety awareness and self-protection ability.
Organs, groups, enterprises and institutions, village (resident) committees, etc. shall carry out publicity and popularization of elevator safety knowledge, and advocate civilized use of elevators.
Kindergartens and schools should take elevator safety knowledge as an important part of safety education, and cultivate children and students the habit of using elevators in a safe and civilized manner.
News media should carry out public welfare publicity about elevator safety and guide the public to use elevators correctly.
Article 7 Encourage the adoption of new technologies and methods such as big data and the Internet of Things to promote the intelligent and information-based development of elevator production, use, maintenance, inspection, testing, emergency response, and supervision and management, and to improve the level of elevator safety management.
Article 8 Elevator manufacturing units, user units, and maintenance units are encouraged to purchase elevator safety liability insurance individually or jointly.
Promote elevator safety liability insurance for elevators in schools, medical institutions, stations, shopping malls and other public gathering places.
Article 9 Elevator industry associations shall strengthen industry self-discipline management, formulate industry service standards, participate in the formulation of relevant standards, promote the construction of industry integrity systems, and promote industry orderly competition and standardized operation.
Chapter 2 Selection, Configuration and Production
Article 10 The selection and configuration of elevators shall be adapted to the building structure and usage needs, comply with the relevant national and provincial regulations and standards, and ensure the needs of rescue and barrier-free passage.
The escalators and moving walks newly installed in stations, airports, passenger terminals, rail transit stations, pedestrian crossing facilities and other places shall use public transport elevators that meet the standards in accordance with relevant state regulations.
Where an elevator is installed in a construction project using fiscal funds, the elevator safety performance, failure rate, and after-sales service and credit status of the elevator manufacturing unit and sales unit shall be included in the evaluation content of procurement or bidding.
Article 11 For new construction, reconstruction and expansion projects, the construction unit shall entrust a unit with corresponding qualifications to carry out the design and construction of elevator civil works such as elevator shafts, pits, machine rooms and landings in accordance with the requirements of laws, regulations and safety technical specifications , Supervision. The anti-leakage warranty period for elevator civil works shall not be less than five years, from the date when the project is completed and accepted to calculate.
If an elevator is added to an existing residence, the civil construction shall comply with the project quality requirements, and the anti-leakage warranty period shall comply with the provisions of the preceding paragraph.
Article 12 The elevator manufacturing unit is the main body responsible for product quality, and shall be responsible for the safety performance of the elevator and perform the following obligations:
(1) Provide technical guidance and services necessary for the safe operation of elevators, and assist in troubleshooting elevator failures;
(2) Follow up and investigate and understand the safe operation and maintenance of elevators, and put forward suggestions for improvement on existing problems;
(3) If the elevator has an identity defect that endangers safety due to design, manufacturing and other reasons, it shall immediately stop manufacturing, take the initiative to recall it, notify the user in a timely manner, and report to the market supervision and management department;
(4) Other obligations stipulated by laws, regulations and safety technical specifications.
Elevator manufacturing units shall not adopt any technical means to limit the normal maintenance of elevators and affect the safe operation of elevators.
Article 13 If an elevator manufactured overseas is sold in this Municipality, and the manufacturing unit has not established a direct sales agency in China, it shall be clear that the agent registered in China shall first assume the safety responsibility of the elevator manufacturing unit stipulated by laws and regulations.
Article 14 Before the newly installed passenger elevator is delivered for use, the construction unit shall complete the mobile communication signal coverage of the elevator car and the hoistway.
Encourage existing manned elevator cars and shafts to achieve mobile communication signal coverage.
Article 15 After the newly installed passenger elevator is delivered for use, the elevator manufacturing unit and maintenance unit shall transmit the elevator safety operation data in real time to the Internet of Things smart supervision platform uniformly established by the Municipal People's Government.
When the existing manned elevators are renovated, the functions of data collection and transmission of elevator safe operation should be realized.
Article 16 Elevator manufacturing units or sales units shall bear the responsibility for quality warranty of the elevators they manufacture and sell. The minimum warranty period shall not be less than five years from the date of passing the elevator installation supervision and inspection.
Repair services involving elevator quality problems are provided within the warranty period, and no fee shall be charged.
Article 17 The installation, modification and repair of elevators shall be carried out by the elevator manufacturing unit or the unit with corresponding qualifications entrusted by it. The entrusted unit shall not sub-entrust or in a disguised form to entrust the elevator installation, transformation and repair business.
If the original elevator manufacturing unit has been cancelled or no longer has the corresponding qualifications, and the elevator needs to be renovated or repaired, the elevator user unit may entrust other units with corresponding qualifications to implement it with the consent of the owner. The construction unit shall be responsible for the safety performance of the elevator after renovation or repair.
If the elevator is to be renovated, the construction unit shall replace the elevator product sign, indicating the name of the renovation unit, the date of renovation, and the number of the renovation qualification certificate and other relevant information.
Article 18 Before elevator installation, renovation and repair, the construction unit shall formulate a safety construction plan, implement safety protection measures, and inspect the elevator shaft, pit, machine room and landing and other civil works in accordance with the requirements of elevator design documents and standards. Confirm the elevator condition and meet the requirements before construction.
Article 19 After the installation, transformation and repair of the elevator are completed and passed the supervision and inspection, the elevator construction unit will hand over the key and relevant materials to the elevator user, which is the delivery for use. The elevator construction unit shall take measures to ensure the safety of the elevator before delivery.
Article 20 It is supported to add elevators to existing residences where conditions permit, and the added elevators shall meet the requirements of elevator safety management.
Chapter 3 Use Management
Article 21 The elevator users shall be determined in accordance with the following provisions:
(1) If the newly installed elevator has not been handed over to the owner, the construction unit shall be the user;
(2) If the elevator belongs to one owner, the owner is the user;
(3) If the elevator is jointly owned by multiple owners, and the owners manage it by themselves, the owner shall determine the user through a written agreement;
(4) Where the right to use a place containing an elevator is leased, lent or otherwise transferred, it may be agreed that the user shall be the user; if there is no agreement, the owner of the elevator shall be the user;
(5) If the management is entrusted to a property service provider, the trustee shall be the user unit.
If an elevator is added to an existing residence, the owner shall determine the unit of use before the elevator is put into use.
If the elevator user cannot be determined, the local town people's government, sub-district office, and development zone (park) management agency shall urge the owner to determine the user, or designate the user.
Article 22 The elevator user shall go through the registration of elevator use in accordance with the law; if the elevator user changes, it shall go through the change registration with the market supervision and management department within 30 days from the date of change.
When the elevator user changes, the complete elevator safety technical file and other relevant materials should be handed over.
Article 23 The elevator user is the main body responsible for the safety of elevator use, should be responsible for the safety of elevator use, and perform the following obligations:
(1) Establish elevator safety management system and elevator safety technical files.
(2) Elevator safety management institutions shall be set up or equipped with elevator safety management personnel in accordance with regulations, and publicity shall be made in the management area.
(3) Post effective signs for the use of special equipment, instructions for safe use, the contact person and contact information of the elevator user, and emergency rescue telephone numbers in prominent positions in the elevator car.
(4) Keep the elevator shaft, pit, machine room, etc. dry and free of water leakage, and meet the environmental requirements such as temperature, humidity, and illumination for the safe operation of the elevator.
(5) Conduct on-site supervision and signature confirmation of maintenance operations, cooperate with on-site safety work, and incorporate the confirmation data into the elevator safety technical file.
(6) If the elevator is found to be faulty or abnormal, or receives a report of the hidden danger of the accident from the elevator maintenance unit and inspection and testing agency, it shall organize a comprehensive inspection in time to eliminate the hidden danger of the accident; before the hidden danger of the accident is eliminated, the elevator shall be stopped.
(7) Carry out daily inspections on the use of elevators, keep the elevator hall, elevator doors and the inside of the car clean and tidy, guide and supervise the correct use of elevators by passengers, and promptly discourage abnormal use of elevators.
(8) Other obligations stipulated by laws, regulations and safety technical specifications.
Article 24 Elevator users in public gathering places and residential quarters shall equip elevators with video surveillance facilities that comply with public safety video management regulations, and ensure the normal operation of public safety video surveillance facilities.
The collection, use and management of video image information shall be carried out in accordance with the law and shall not infringe upon the legitimate rights and interests of others.
Article 25 For the decoration of the elevator car, after the decoration is completed, it can be put into use only after it has been confirmed by the elevator manufacturer or has been inspected and tested to meet the relevant safety technical specifications.
Installation of electronic display screens and other facilities in the elevator car shall not affect the safety performance of the elevator.
Article 26 If one of the following circumstances may affect the safety of elevator use, the elevator user may entrust an institution with inspection and testing qualifications to conduct elevator safety assessment:
(1) The elevator has been used for more than 15 years;
(2) Casualties caused by elevator failure;
(3) Disabled due to the impact of floods, fires, earthquakes and other disasters;
(4) Other circumstances that affect the safe use of elevators.
The conclusion of the elevator safety assessment should be used as a reference for whether to continue to use the elevator or to renovate, repair or update the elevator.
Article 27 If the elevator user deactivates the elevator, it shall take necessary safety protection measures.
If the elevator is to be out of use for more than one year, the elevator user shall notify the market supervision and administration department in writing within 30 days from the date of deactivation. If the elevator is reactivated, the elevator user shall conduct inspection in accordance with relevant national and provincial regulations, and can only be activated after passing the inspection, and notify the market supervision and management department in writing.
Article 28 If the elevator has serious hidden dangers of accidents, has no value for transformation or repair, or meets other scrapping conditions stipulated in the safety technical regulations, the elevator user shall perform the scrapping obligation according to the law, take necessary measures to eliminate the function of the elevator, and report to the original registered person. The market supervision and administration department shall go through the cancellation procedures of the use registration certificate.
Article 29 If the elevators in residential areas need to be renovated, repaired or updated, they may apply for the use of special residential maintenance funds in accordance with regulations. If there is no special residential maintenance fund or the special residential maintenance fund is insufficient, the elevator owner shall bear the relevant expenses.
Municipal, county-level city and district people's governments may, according to the needs of the safety management of old elevators in their respective administrative regions, establish a financing mechanism for elevator renovation, repair, and renewal.
Article 30 Elevator passengers shall abide by the requirements of elevator safety precautions and warning signs, and shall not have the following behaviors that affect the safe operation of elevators:
(1) Take an elevator that is expressly inactive;
(2) Use the elevator beyond the rated load;
(3) Carrying flammable, explosive and other dangerous substances or other substances that may affect the safety of elevators;
(4) Playing, playing, jumping, smoking in the elevator, or climbing, retrograde, or staying at the entrance or exit of the running escalator or moving sidewalk;
(5) Using abnormal means to open elevator landing doors and car doors;
(6) Destroying elevator safety signs, rescue signs, spare parts and other ancillary facilities;
(7) Leaving construction (decoration) garbage, domestic garbage, and defecation in the elevator car;
(8) Use emergency stop devices in non-emergency situations;
(9) Other behaviors that affect the safe operation of elevators.
It is forbidden to use a passenger elevator to carry electric bicycles or their batteries. Any unit or individual has the right to dissuade; those who do not obey the dissuasion shall report to the fire rescue agency in a timely manner.
Chapter 4 Maintenance, Inspection and Testing
Article 31 Entities that carry out elevator maintenance business shall meet the corresponding qualification requirements, set up a fixed office space, and be equipped with corresponding qualified operators, and notify the market supervision and management department in writing before carrying out elevator maintenance work for the first time. If the information changes, it shall notify the market supervision and administration department within 15 days from the date of the change.
Article 32 The elevator maintenance unit shall be responsible for the safety performance of its maintenance elevator, and abide by the following provisions:
(1) According to the elevator safety technical specifications, relevant standards and the actual situation of elevator use, formulate a maintenance plan;
(2) Establish elevator maintenance files, record the maintenance situation truthfully, and keep the files for a period of not less than four years;
(3) Use the unit's operators to carry out maintenance;
(4) At least once a year, organize safety education and skills training for the operators of the unit, and keep the records of safety education and skills training for not less than two years;
(5) Conduct irregular inspections on the maintenance quality of elevators, supervise and record the performance of duties by operators;
(6) Necessary safety protection measures shall be taken at the maintenance site. If the protection measures are insufficient to ensure safety, a special person shall be dispatched to protect the site to ensure construction safety;
(7) The replaced elevator parts shall have the product quality certificate, and the safety protection device shall have the type test certificate;
(8) After discovering the fault or receiving the fault notification, the fault shall be eliminated in time; if the fault is temporarily difficult to be eliminated, the elevator user shall be informed of the solution in writing, and the elevator user shall be informed to stop the elevator before the fault is eliminated.
For elevators used in high-intensity public gathering places, the maintenance frequency and maintenance items should be increased.
Article 33 The elevator maintenance unit shall not subcontract or subcontract the maintenance business without the consent of the elevator user.
Article 34 If an elevator maintenance unit finds any of the following circumstances, it shall submit a written opinion to the elevator user to stop the elevator, cooperate with the elevator user to take effective safety measures, and report to the market supervision and management department:
(1) using elevators that have not been inspected or failed to pass inspection;
(2) using elevators that have been deactivated or scrapped;
(3) Renovating, repairing or updating elevators in violation of regulations;
(4) Other situations that seriously endanger the safety of elevator use.
Article 35 Promote the large-scale and professional development of elevator maintenance units, and use advanced technologies such as digitalization and advanced management methods to carry out elevator maintenance.
Encourage elevator maintenance units to carry out self-declaration of service standards and public commitment to service quality, publicize maintenance plans, maintenance implementation and other information, and provide services that are better than national standards.
Elevator maintenance units can take targeted offline on-site maintenance based on real-time online inspection and monitoring of maintenance conditions.
Article 36 Institutions engaged in elevator inspection and testing shall obtain corresponding qualifications in accordance with the law, abide by the relevant regulations on elevator inspection and testing, and before the first elevator inspection and testing in this city, the organization's qualifications, office space, employees , Quality assurance system and relevant information on inspection and testing work shall be notified in writing to the municipal market supervision and management department.
Article 37 Elevator inspection and testing agencies shall carry out inspection, testing and safety assessment work in accordance with the requirements of laws, regulations and safety technical specifications, issue reports objectively and in a timely manner, be responsible for inspection, testing results and evaluation conclusions, and pass data as required The information exchange system submits the report to the market supervision and management department.
Article 38 If the elevator inspection and testing agency finds that the elevator has hidden dangers in the inspection and testing, it shall notify the elevator user in writing; if it is a serious hidden danger, it shall report to the market supervision and management department at the same time.
Chapter V Emergency Response
Article 39 The people's governments of cities, county-level cities and districts shall establish an elevator emergency rescue system to coordinate and ensure the safety and emergency rescue of elevators in a unified manner.
Article 40 The market supervision and management department shall formulate elevator emergency plans, use the city's unified elevator safety emergency response platform to organize, direct and coordinate the city's elevator emergency rescue work, and connect with the Internet of Things smart supervision platform to achieve information sharing.
The public security organs and fire rescue agencies shall cooperate in the elevator safety emergency rescue and disposal work according to their duties, and support the operation of the elevator safety emergency disposal platform.
The elevator maintenance unit shall execute the dispatch instructions of the elevator safety emergency response platform; if the elevator safety emergency response platform fails to respond to the dispatch command in time, the elevator safety emergency response platform can dispatch other elevator maintenance units nearby for rescue.
Article 41 The elevator users and maintenance units shall formulate special emergency plans for elevator accidents, and conduct emergency drills in accordance with the requirements of safety technical regulations.
Article 42 An elevator user shall establish a 24-hour duty system, set up a duty telephone and keep it unblocked.
After discovering the elevator trapped person failure or receiving the elevator trapped person failure report, the elevator user shall organize rescue immediately, notify and assist the maintenance unit to carry out the rescue, and take measures to appease the trapped person and rescue the injured person.
In the event of an elevator accident, the elevator user shall immediately notify the maintenance unit to organize emergency rescue, protect the accident site, prevent the accident from expanding, and promptly report to the market supervision and management department where the accident is located.
Article 43 Except for force majeure, the elevator maintenance unit shall rush to the scene within 30 minutes to carry out rescue after receiving the report of the elevator trapped person failure. Fault.
Article 44 After receiving the report of an elevator accident, the market supervision and management department shall rush to the scene immediately, investigate and understand the situation, instruct the elevator users and maintenance units to carry out on-site rescue, and conduct investigation and handling in accordance with relevant state regulations.
Article 45 If personal injury is caused by an elevator accident, the elevator user shall do a good job in the rescue of the injured person. If the elevator safety liability insurance has been insured, the elevator user The elevator insurer shall be notified to activate the emergency advance payment and payment mechanism for elevator accidents in a timely manner.
Chapter VI Supervision and Management
Article 46 The market supervision and management department shall formulate a safety supervision and inspection plan every year, and conduct supervision and inspection of elevator production, use, and maintenance units and inspection and testing institutions in accordance with relevant regulations.
Supervision and inspection may entrust professional institutions to provide technical services, and the results of supervision and inspection shall be announced to the public in a timely manner.
Article 47 The market supervision and management department shall implement key safety supervision and inspection on the following elevators:
(1) Elevators used in public gathering places;
(2) Elevators that have had accidents in the past two years;
(3) Elevators with more than two trapped failures within 30 days;
(4) Other elevators that need to implement key supervision and inspection.
Article 48 The market supervision and management department shall conduct an assessment of elevator maintenance units every year, and disclose the assessment results to the public.
Article 49 The housing and urban-rural development department shall do a good job in the selection and configuration of elevators, the design review of civil works, waterproofing, power supply and distribution and other supporting facilities, and the supervision of the construction quality of elevator civil works such as elevator shafts, pits, and machine rooms.
The public security organ shall investigate and deal with illegal acts that damage elevator facilities, disturb the order of passengers, and impede the safety of operation in accordance with the law.
Departments of education, transportation, commerce, culture, broadcasting, tourism, health and other departments shall urge elevator users in the industry to fulfill their elevator use safety obligations.
Article 50 The town people's government, the sub-district office, and the management organization of the development zone (park) shall assist the relevant departments to conduct daily inspections of elevator safety, urge the implementation of elevator safety responsibilities, and coordinate and handle conflicts and disputes in the use of elevators.
Article 51 The market supervision and management department shall establish an elevator safety complaint and report system, and announce the channels for complaints and reports.
Any unit or individual who discovers behaviors that endanger elevator safety may file a complaint or report to the market supervision and management department. The market supervision and management department shall investigate and handle in a timely manner, and inform the complainant or whistleblower of the handling result.
Article 52 If an elevator accident occurs, the hidden danger of the accident has not been eliminated in time, or there are other safety management problems, the market supervision and management department may interview the main person in charge of the relevant unit and require him to implement the elevator safety responsibility.
Article 53 The municipal market supervision and management department shall issue a report on the safety status of elevators in this city every year, reflecting the status of elevator quality and maintenance quality.
Chapter VII Legal Liability
Article 54 For those who violate the provisions of these Regulations, and the laws and regulations have provisions for punishment, the provisions shall prevail.
Article 55 Violating the provisions of the first paragraph of Article 15 of these regulations, the elevator manufacturing unit and maintenance unit fail to transmit the elevator safety operation data in real time to the Internet of Things smart supervision platform uniformly established by the Municipal People's Government, and shall be subject to market supervision and management The department shall order it to make corrections within a time limit; if it fails to make corrections within the time limit, it shall impose a fine of not less than 10,000 yuan but not more than 30,000 yuan.
Article 56 If the elevator user violates the provisions of Article 23, item 5 of these regulations, and the elevator user fails to conduct on-site supervision and signature confirmation of the maintenance operation, the market supervision and management department shall order it to make corrections within a time limit; A fine of not less than 1,000 yuan but not more than 20,000 yuan.
Article 57 In violation of the provisions of Article 28 of these Regulations, the elevator has serious hidden dangers of accidents, has no value for renovation or repair, or meets other scrapping conditions stipulated in the safety technical regulations, and the elevator user fails to perform the scrapping obligation and handle the use registration according to law. If the certificate is cancelled, the market supervision and administration department shall order to stop using the elevator and impose a fine of not less than 30,000 yuan but not more than 300,000 yuan.
Article 58 If an elevator passenger violates the provisions of Article 30, Paragraph 1, Item 1 to Item 8 of these regulations, and the elevator passengers have behaviors that affect the safe operation of the elevator, the relevant departments shall order corrections and impose penalties according to law; it constitutes a violation of public security management. If a crime is constituted, criminal responsibility shall be investigated according to law; if personal or property damage is caused to others, it shall be liable for compensation according to law.
Violating the provisions of paragraph 2 of Article 30 of these Regulations, if an elevator passenger uses a passenger elevator to carry an electric bicycle or its battery, and refuses to obey the dissuasion, the fire rescue agency shall impose a fine of not less than 200 yuan but not more than 1,000 yuan; Those who conduct public security administration shall be punished according to law; those who constitute a crime shall be investigated for criminal responsibility according to law; those who cause personal or property damage to others shall be liable for compensation according to law.
Article 59 If the elevator maintenance unit violates the provisions of Article 32, paragraph 1, item 3 of these regulations, the elevator maintenance unit does not use its operators to carry out maintenance, the market supervision and management department shall order it to make corrections, and impose a fine of more than 10,000 yuan and three A fine of less than 10,000 yuan.
Article 60 If the elevator maintenance unit violates the provisions of Article 33 of these regulations, the elevator maintenance unit subcontracts or subcontracts the maintenance business without the consent of the elevator user unit, the market supervision and management department shall order it to make corrections, and impose a fine of more than 10,000 yuan and 100,000 yuan. Article 64 The staff of the relevant departments of elevator safety supervision and management who abuse their powers, neglect their duties, or engage in favoritism and fraud in the work of elevator safety supervision and management shall be punished according to law; if a crime is constituted, criminal responsibility shall be investigated according to law.
Chapter VIII Supplementary Provisions
Article 65 These Regulations shall come into force on February 1, 2022.
